Where prohibited conduct is detected or reasonably suspected, ph359 reserves the right to take immediate action including account suspension, balance forfeiture, and reporting to PAGCOR and law enforcement authorities.

ph359's total aggregate liability to you for any claim arising out of or relating to these Terms or your use of the Platform shall not exceed the total amount deposited by you into your ph359 account in the thirty (30) days immediately preceding the event giving rise to the claim.

ph359 does not warrant that the Platform will be uninterrupted, error-free, or free from viruses or other harmful components. The Platform is provided on an "as is" and "as available" basis. ph359 makes no representations or warranties of any kind, express or implied, regarding the operation of the Platform or the information, content, or materials included therein.

Nothing in these Terms shall limit or exclude ph359's liability for fraud, gross negligence, or any other liability that cannot be excluded or limited under applicable Philippine law.

ph359 collects, processes, and stores personal data in accordance with the Philippine Data Privacy Act of 2012 (Republic Act No. 10173) and its implementing rules and regulations. The collection and use of your personal data is governed by the ph359 Privacy Policy, which is incorporated into these Terms by reference.

By registering an account on ph359, you consent to the collection, processing, and storage of your personal data as described in the Privacy Policy. You have the right to access, correct, and request deletion of your personal data, subject to applicable legal and regulatory retention requirements. ph359 implements appropriate technical and organizational security measures to protect your personal data against unauthorized access, disclosure, alteration, or destruction. However, no method of transmission over the internet or electronic storage is completely secure, and ph359 cannot guarantee absolute security.

ph359 reserves the right to suspend, restrict, or permanently close your account at any time, with or without prior notice, for any of the following reasons:

• Breach of any provision of these Terms.
• Suspected or confirmed fraudulent activity, bonus abuse, or prohibited conduct.
• Failure to complete KYC verification within the required timeframe.
• Receipt of a chargeback or payment dispute from your payment provider.

• Any other reason that ph359 determines, in its sole discretion, warrants account closure.

Upon account closure for reasons other than breach or fraud, any remaining real-money balance (excluding bonus funds) will be returned to you via your verified payment method, subject to completion of KYC verification and any applicable withdrawal processing requirements.

If a dispute cannot be resolved informally, both parties agree to submit to the exclusive jurisdiction of the competent courts of the Philippines. Players who believe their dispute involves a regulatory matter may also escalate their complaint to PAGCOR through the appropriate regulatory channels.

ph359 reserves the right to amend, update, or replace these Terms at any time. When material changes are made, ph359 will notify registered players via email or through a prominent notice on the Platform. The updated Terms will take effect on the date specified in the notice.

Your continued use of the ph359 Platform after the effective date of any amended Terms constitutes your acceptance of the revised Terms. If you do not agree to the amended Terms, you must stop using the Platform and may request account closure in accordance with Section 12.
